Article 1 — Legal Notice
The website majoliecerise.com is published by BATUCADA SAS, a simplified joint-stock company (société par actions simplifiée) incorporated under French law, with a share capital of €10,000, registered with the Registre du Commerce et des Sociétés (RCS) of Saint-Brieuc under number 481 442 325. Article 2 — Scope of Application
These General Terms and Conditions of Sale (the "GTC") apply to all orders placed on majoliecerise.com by a non-professional customer (consumer). By placing an order, the customer accepts these GTC in full and without reservation. These GTC comply with applicable European Union consumer law, including Directive 2011/83/EU on consumer rights, and French law.
Article 3 — Products
The products offered for sale are jewellery items from the Ma Jolie Cerise brand. Product photographs and descriptions are provided for illustrative purposes only. BATUCADA undertakes to offer products that are consistent with their description. In the event of any discrepancy, applicable EU consumer law shall prevail.
Article 4 — Prices
All prices are displayed in euros, inclusive of all applicable taxes (VAT included). BATUCADA reserves the right to modify its prices at any time; the price applicable to any given order is the price in force at the time the order is confirmed. Prices include French VAT at the applicable rate. For orders delivered within the EU, prices may be adjusted to reflect the VAT rate applicable in the customer's country of residence in accordance with EU VAT rules.
Article 5 — Orders
The customer places their order online via majoliecerise.com. The order is confirmed by the sending of a confirmation email to the address provided by the customer. BATUCADA reserves the right to cancel any order in the event of a dispute relating to a previous payment, suspected fraud, or stock unavailability. In such cases, the customer will be notified promptly and any payment received will be refunded.
Article 6 — Payment
Payment is made online by the following methods: bank card (Visa, Mastercard, CB) and PayPal. All transactions are processed via a secure, encrypted payment gateway. BATUCADA does not store any banking or card details. In accordance with PSD2 (EU Directive 2015/2366), strong customer authentication (SCA) may be required.
Article 7 — Shipping and Delivery
Orders are dispatched within 1 to 5 business days following payment confirmation. Delivery is carried out by La Poste (tracked mail) or Colissimo, to mainland France and across Europe. Shipping costs are displayed at checkout before the order is confirmed.
Estimated delivery times are provided for information only. BATUCADA shall not be held liable for delays attributable to the carrier. In the event of a lost or significantly delayed shipment, the customer is encouraged to contact us so that we may open an inquiry with the carrier. Customers in the EU retain the right to request a full refund if delivery is not completed within 30 days of the agreed delivery date, in accordance with Article 18 of Directive 2011/83/EU.
Article 8 — Right of Withdrawal
In accordance with Article 16(e) of Directive 2011/83/EU, the right of withdrawal does not apply to goods that are liable to deteriorate or expire rapidly, or to sealed goods that are not suitable for return due to health protection or hygiene reasons and which have been unsealed after delivery.
All jewellery and intimate-contact products sold on majoliecerise.com are items that come into contact with the skin or intimate areas. For hygiene reasons, all sales are final. No returns, exchanges, or refunds will be accepted once the product has been delivered, except in the event of a defective or incorrectly delivered item (see Article 9).
For product categories that are not subject to this hygiene exception, European consumers retain the right to withdraw from a purchase within 14 calendar days of receipt, without providing any reason, in accordance with Directive 2011/83/EU.
Article 9 — Legal Guarantees
The customer benefits from the following statutory guarantees under French and EU law:
Legal guarantee of conformity: pursuant to Articles L217-4 et seq. of the French Consumer Code (and Directive 2019/771/EU on contracts for the sale of goods), BATUCADA is liable for any lack of conformity that exists at the time of delivery. The customer has two years from delivery to invoke this guarantee. In such cases, the customer may request repair or replacement of the item, or — if neither is possible — a price reduction or full refund.
Guarantee against hidden defects: pursuant to Articles 1641 et seq. of the French Civil Code, BATUCADA is liable for hidden defects that make the product unfit for its intended use. The customer has two years from the discovery of the defect to bring a claim.

Article 10 — Liability
BATUCADA shall not be held liable for any indirect damages arising from the use of its products (including loss of profit, loss of data, or reputational damage). BATUCADA's liability for any direct damage shall be limited to the amount paid by the customer for the order in question. Nothing in these GTC shall limit or exclude BATUCADA's liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable EU or French law.
Article 11 — Personal Data
Personal data collected in connection with an order is processed in accordance with our Privacy Policy, available on the website. In compliance with Regulation (EU) 2016/679 (GDPR), customers have the right to access, rectify, erase, and port their personal data, as well as the right to object to or restrict its processing. Article 12 — Applicable Law and Dispute Resolution
These GTC are governed by French law. In the event of a dispute, the parties shall first seek an amicable resolution. In accordance with EU Regulation No. 524/2013 on online dispute resolution, European consumers may also submit a complaint via the EU ODR (Online Dispute Resolution) platform at: ec.europa.eu/consumers/odr. Failing amicable resolution, the competent French courts shall have exclusive jurisdiction.
These GTC have been drafted in compliance with Directive 2011/83/EU on consumer rights, Directive 2019/771/EU on the sale of goods, and the French Consumer Code (Code de la consommation). They do not affect your statutory rights as a consumer under EU law.
